Bonnie M. Boryca

Experienced litigator and problem-solver for businesses, individuals, employers, and employees.

Bonnie Boryca is a member of Erickson | Sederstrom’s labor & employment, litigation, and appellate practice groups. Her practice focuses on advising and resolving employment matters, complex commercial and business litigation, technology litigation, and trust and estate disputes. Bonnie has the experience to assist clients in reaching resolutions and achieving results.

Bonnie frequently advises employers and business owners regarding HR policies and procedures. She helps guide employee investigations and responses to grievances. In certain instances, Bonnie provides advice to executives, directors, and company officers regarding their employment situations at their companies, including employment agreements when joining an organization and separation or severance agreements when their time with a company comes to an end. Bonnie has also helped federal employees in addressing their claims, benefits, or compensation at the federal agencies where they have worked.

In addition, Bonnie often works with business owners on strategic advice to prevent, avoid, or work through ownership disputes. The goal is for shareholders, LLC members, and partners to be on the same page and stay there.

Bonnie often appears before courts in Nebraska, Kansas, and Iowa as well as state and federal agencies, such as the EEOC, NEOC, Department of Labor and others. She has argued appeals before the Kansas Court of Appeals, the Nebraska Supreme Court, the Nebraska Court of Appeals, the United States Court of Appeals for the Tenth Circuit, and the United States Court of Appeals for the Eighth Circuit.

Bonnie is a Contributing Editor of the Nebraska and the Upper Midwest Employment Law Letter and a presenter on employment law topics. She is a member of the firm’s Board of Directors, has been recognized by Super Lawyers and Best Lawyers, and is actively involved in the Omaha community.

Additional Information

Bonnie received her undergraduate degree from Creighton University, where she studied English and philosophy.

While attending the University of Kansas School of Law, Bonnie was an articles editor for the Kansas Law Review. She was awarded Best Oral Advocate at KU’s moot court competition, and she and her teammate won second place at the National Criminal Procedure Moot Court Competition in November 2009. Upon graduation, she was admitted to the Order of the Coif.

Bonnie currently serves as the Vice President of Erickson | Sederstrom’s Board of Directors. She is a lifelong Omaha resident, other than her time living in Kansas and attending KU. She enjoys spending time with her family and being active outdoors.

  • Prevailed on Motion for Summary Judgment on all employee claims, including FMLA and ADA claims, against regional restaurant employer in January 2023. Currently on appeal to the Eighth Circuit Court of Appeals.

  • Dana Partnership, LLP v. McLeay, et al., District Court of Douglas County Nebraska, Unanimous jury verdict following five-day trial on bifurcated affirmative defense alleging that the plaintiff dissociated or withdrew as a member of an LLC formed with the defendants.

  • Ryan v. Streck, Inc., 309 Neb. 98, 958 N.W.2d 703, Nebraska Supreme Court. District court’s dismissal on statute of limitations grounds reversed by the Nebraska Supreme Court.

  • BAC Local Union 15 Welfare Fund, et al. v. Williams Restoration Company, et al, United States District Court for the District of Kansas. Motion for partial summary judgment on liability for union benefit contributions denied.

  • Ryan v. Streck, Inc., 889 F.3d 499, United States Court of Appeals for the Eighth Circuit. Reversal of the district court’s denial of motion to vacate its dismissal of breach of contract claim and remanded for further proceedings.

  • Ayres v. Neb. Dept. of Health and Human Servs., et al., United States District Court for the District of Nebraska. Motion to dismiss granted to dismiss non-governmental party from the suit due to failure to state a claim against it.

  • Antaki v. Saint Francis Medical Center, United States District Court for the District of Nebraska. Summary judgment granted on all claims of tortious interference with contract or business relationship.

  • Bell v. Grow With Me, et al., 299 Neb. 136, 907 N.W.2d 136, Nebraska Supreme Court. Directed verdict entered during jury trial by district court was upheld on appeal.

  • Salem Grain Company, Inc. v. Consolidated Grain and Barge Co., et al., 297 Neb. 682, 900 N.W.2d 909, Nebraska Supreme Court. District court’s order of dismissal for failure to state claims under the affirmative defense set forth in the Noerr-Pennington doctrine was affirmed on appeal.

  • Frederick v. City of Falls City, et al., 295 Neb. 795, 890 N.W.2d 498, Nebraska Supreme Court. District court’s denial of request to re-open prior case in which plaintiff unsuccessfully sought a writ of mandamus was upheld on appeal.

  • Claassen v. General Casualty Company of Wisconsin, United States District Court for the District of Nebraska. Summary judgment granted on all claims related to an insurance contract interpretation.

  • Frederick v. City of Falls City, et al., 289 Neb. 864, 857 N.W.2d 569, Nebraska Supreme Court. Appeals court reversed district court’s ruling that non-municipal party had to comply with public records requests, finding it was not subject to Nebraska public records requirements.

  • Riley v. Outlook Nebraska, Inc., United States District Court for the District of Nebraska. Favorable rulings on all claims after bench trial.
